PREAMBLE
The company koddelDecor is the publisher and operator of the website koddel.com, a sole proprietorship.
These General Terms and Conditions of Sale govern all contracts concluded through the website accessible at the URL koddel.com. They are concluded between:
- koddelDecor, whose registered office is located at 15B rue de l'Arrivée, 95880 ENGHIEN LES BAINS, France, SIRET number 533 965 943 00038, APE code 4789Z 533 965 R.C.S. Pontoise
hereinafter referred to as "koddel.com" on the one hand
AND
- the CLIENT, whether a private individual or a professional, on the other hand.
The CLIENT and the COMPANY koddelDecor will be collectively referred to as the PARTIES.
Important:
Any order placed on the koddel.com website necessarily implies the CLIENT's unreserved acceptance of these general terms and conditions of sale.
It is under these conditions that the parties have agreed as follows:
Article 1: Definitions
The terms mentioned below have the following meanings in these general terms and conditions of sale:
PRODUCTS: refers to all products available on the website www.koddel.com
E-COMMERCE WEBSITE: refers to the website accessible at: http://www.koddel.com/
The e-commerce website includes all hosted web pages and products offered to CUSTOMERS.
CUSTOMER: refers to the contracting party of Koddel DECOR, who guarantees to be a private individual/consumer as defined by French law and case law.
GENERAL TERMS AND CONDITIONS OF SALE or GTC: refers to this contract, deemed accepted by the parties.
DELIVERY: Delivery is considered complete on the date of the first presentation of the PRODUCTS at the delivery address indicated by the CUSTOMER when placing the order.
TERRITORY: Refers to metropolitan France, Corsica and Monaco and the countries of the European Union and internationally.
Article 2: Purpose of the Contract
These General Terms and Conditions of Sale (GTC) define the contractual provisions relating to the respective rights and obligations of the PARTIES within the framework of the sale of PRODUCTS carried out on the E-COMMERCE WEBSITE.
Article 3: Amendments to the GTC
koddelDECOR may amend these GTC at any time. The CUSTOMER will be informed of the nature of these amendments as soon as they are published online on the website http://koddel.com.
The amendments will take effect immediately upon being published on the website.
Only the GTC published on the day of the order are applicable. They are brought to the CUSTOMER's attention when the order is placed, and the CUSTOMER must accept them before any confirmation of the order.
Article 4: Nature of the GTC
These GTC do not, under any circumstances, confer upon the CUSTOMER the status of employee, agent, representative, or representative of KODDELDECOR.
The PARTIES further declare that these General Terms and Conditions of Sale (GTC) cannot under any circumstances be considered as constituting a legal entity or any other legal person, and that any form of "affectio societatis" (partnership) is expressly excluded from their relationship.
Article 5: Products Offered
Online Presentation of PRODUCTS:
All PRODUCTS are described by KODDEL DECOR as accurately as possible based on information provided by suppliers.
The photographs of the PRODUCTS are as faithful as possible but cannot guarantee a perfect likeness to the PRODUCTS sold, particularly with regard to colors. These photos are therefore not contractually binding.

Stock limitations:
Products ordered and promotional offers from koddel.com are valid only while stocks last.
Article 6: Price
All orders placed on the website accessible at http://www.koddel.com are payable upon ordering.
The CUSTOMER may pay for their order using the following methods:
- Stripe: The buyer may pay by credit card without needing to create a Stripe account.
- Check: The check will be cashed upon receipt, and the order will be processed after the check has cleared.
- Bank Transfer: Payment by bank transfer is possible, both nationally and internationally, via SEPA.
The CUSTOMER may print an invoice showing the VAT by logging into their account or by requesting one using the contact form on the website www.koddel.com.
Product prices may change at any time according to koddel.com's pricing policy. Products ordered are billed at the price in effect when the order is placed.
Delivery charges depend on the destination and the type and/or quantity of products chosen by the customer.
Article 7: Ordering
Any CUSTOMER wishing to purchase a product on the koddel.com website must:
– complete the identification form, providing all the requested information, or provide their customer number if they have one;
– validate their order after reviewing it;
– make payment according to the specified terms;
– confirm their order and payment.
Order confirmation implies acceptance of these terms and conditions of sale, acknowledgment of having read and understood them fully, and waiver of any right to invoke their own terms of purchase or any other conditions.
All data provided and the recorded confirmation will serve as proof of the transaction. Confirmation will constitute a signature and acceptance of the transactions carried out.
koddel France retains ownership of the PRODUCTS until full payment of the order, i.e., until the order price has been received by koddelDecor.
Koddel France will only bear the risks associated with the PRODUCTS until they are delivered to the address provided by the CUSTOMER on the order form.
The order will be prepared by koddelDecor after order confirmation and within the timeframe indicated on the website, koddel.com, at the time the Customer placed the order (except in cases of force majeure: computer errors or errors in stock quantity entry).
The Customer can check the status of their order at any time on the koddel.com website by consulting the "Order Tracking" section.
Article 8: Delivery
The PRODUCTS available on the website http://www.koddel.com can be delivered to Metropolitan France, Corsica, Monaco, and all countries of the European Union, subject to certain financial conditions outlined above.
The DELIVERY period begins once the ORDER has been paid for in full. This period will be specified on the CUSTOMER's order confirmation page. The CUSTOMER is obligated to verify the conformity of the delivered goods upon delivery.
The buyer assumes all risk from the moment the products leave KODDEL DECOR's premises. Any anomaly concerning the product must be reported immediately upon delivery and as soon as possible (within 2 days), in accordance with the terms and conditions of Article 9 of these General Terms and Conditions of Sale.
Any error or modification made by the CUSTOMER to a pending delivery order, regardless of its nature, will result in an extension of the scheduled DELIVERY time, according to the terms defined by the website www.koddel.com. Any resulting additional costs will be borne by the CUSTOMER.
Delivery times are provided for informational purposes only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer refunded.
Article 9: Legal Conformity & Guarantee
For any defects in conformity, the CUSTOMER must notify KODDELDECOR immediately upon delivery, as soon as possible, in accordance with Article 8 of these General Terms and Conditions, of all defects in conformity, in particular via the website koddel.com at the address indicated below: http://koddel.com/contactez-nous
with the following information:
- Order number
- Name, surname, and address
- Reference of the item(s) to be returned
- Reason for return due to non-conformity
- Photo of the product proving the non-conformity
This guarantee is, however, limited to normal use of the PRODUCT.
If the defect in conformity is confirmed, the CUSTOMER may obtain a replacement of the PRODUCT within 30 days.
KODDEL DECOR is not liable for any apparent defects that the CLIENT could have noticed and verified themselves.
However, pursuant to Articles 1641 et seq. of the French Civil Code, all PRODUCTS are covered by the legal guarantee against hidden defects that render them unfit for their intended use, or that so diminish their usability that the buyer would not have purchased them, or would have paid a lower price, had they been aware of the defects.
If the right of return is exercised under the conditions of this article, the CLIENT must return the PRODUCT to the following address:

Article 10: Right of Withdrawal
The consumer CLIENT has a 14-day withdrawal period starting from the date of receipt of goods or acceptance of the offer for services.
The right of withdrawal does not incur any penalty.
The CLIENT must first contact KODDEL.FR by logging into their account, then clicking on "Order History" and then on "Details" on the line corresponding to the order in question. The CUSTOMER can then select the products they wish to return, specifying the following information:
- Order number
- Last name, first name, and address
- Reference number(s) of the item(s) to be returned
The PRODUCTS must be returned via Colissimo or another carrier, in their original packaging and unused, to the following address:

koddelDecor reserves the right to refuse any returned product that is not in its original condition.
The return shipping costs, as well as any storage fees, are the responsibility of the CUSTOMER, and no compensation may be claimed by the CUSTOMER.
koddel.com is legally obligated to reimburse the CUSTOMER no later than 30 days following the date of withdrawal. No refund of the initial shipping costs will be issued.
Article 11: Exchange and Refund Conditions
Exchange Conditions
For any exchange of one or more PRODUCT(S), the CUSTOMER's request must be made within 14 days of the date of receipt of the product(s) in question.
The CUSTOMER must first contact KODDEL.COM by logging into their account, then clicking on "Order History" and then on "Details" on the line corresponding to the order in question. The CUSTOMER can then select the products they wish to return, specifying the following information:
- Order number
- Last name, first name, and address
- Reference of the item(s) to be returned
If the product requested in exchange is of a higher value, the Customer must pay the difference before shipment of the new product, either by bank transfer or by check made payable to KODDEL.COM, to be included in the package of the returned PRODUCT. Conversely, if the amount is less than the initial amount, KODDEL.COM will issue a discount voucher for the difference in price between the new product and the exchanged product.
The new product will be shipped after the exchanged product has been received by KODDEL.COM.
In the case of an exchange, shipping costs remain entirely the responsibility of the CUSTOMER.
Refund Conditions
Refund conditions are subject to Articles 9 and 10 of these Terms and Conditions.

Article 12: Protection of Personal Data
Intellectual Property
All elements of the koddel.com website are and remain the exclusive intellectual property of koddel.com.
No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the website, whether software, visual, or audio.
Personal Data
In accordance with the French Data Protection Act of January 6, 1978, personal information relating to buyers may be processed automatically.
Koddel.com reserves the right to collect information about buyers, including through the use of cookies, and, if it so chooses, to share the collected information with its business partners.
Buyers can object to the disclosure of their contact details by notifying koddel.com. Similarly, users have the right to access and rectify their personal data, in accordance with the law of 6 January 1978.
Article 13: Liability
The company koddel.com shall not be held liable under any circumstances for any failure to perform or improper performance of contractual services attributable to the CLIENT, particularly during the order placement process.
The company koddel decor shall not be held liable, or considered to have breached these terms and conditions, for any delay or failure to perform when the cause of the delay or failure is due to a force majeure event as defined by French case law.
The company koddel decor shall not be held liable under any circumstances for any incident related to the use of the PRODUCTS sold, particularly in the event of fire, burns, or poisoning.
Liability in the event of a delivery delay:
In the event of a delivery delay caused by the carrier compared to the delivery times announced by the carrier, it is the CLIENT's responsibility to contact the carrier first. In the event of significant delays, the CLIENT must contact koddel.com by email service-client@koddel.com (subject: "Delivery delay - order reference") in order to open a dispute file.
In accordance with Article L121-20 of the French Consumer Code, as a consumer (a natural person who places an order with koddel.com acting outside the scope of their trade, business, or profession), you have fourteen (14) days to exercise your legal right of withdrawal.
You do not need to provide any justification for exercising your right of withdrawal. You will not incur any penalty.
During the sales period, koddel.com allows cancellations of all orders, except those with 24-hour delivery (sales "next day at your door"). Orders for these "next day at your door" sales cannot be cancelled. If you wish to exercise your right of withdrawal, please return the order within seven (7) days of receipt.
Liability in case of lost packages
In the event of a lost package, the Customer must contact koddel.com by email at service-client@koddel.com (subject: "Lost package - order reference") within 10 days of receiving the shipping notification from koddel.com, in order to open an investigation to locate the package. Koddel.com will then handle the necessary claims with the carrier.
If the package is not found, koddel.com may either ship a replacement of the same product (subject to availability) or offer the Customer a refund.
Article 14: Archiving - Proof
Koddel.com will archive order forms and invoices on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code.
The computerized records of Koddel.com will be considered by the parties as proof of communications, orders, payments, and transactions between them.
Article 15: Applicable Law
These online sales terms and conditions are governed by French law.
